Where a deceased dies leaving a valid will the executor named in the will must apply to the Probate office to extract a Grant of Probate to carry out the wishes of the deceased in respect of the distribution of property and other assets of the deceased’s estate. Where a deceased dies with no will in place this is commonly referred to as an intestacy and the legal next of kin can apply for a Grant of Administration at the Probate Office. These are very complex and time-consuming processes, and it is important that the executor and next of kin receives expert legal advice to ensure that the application for probate or a grant of administration runs smoothly and is not unduly delayed.
